Darrell Guan's attorney says that the homicide he committed does not constitute murder one. She is wrong, New York Penal Code, Article 125, Section 27, Subsection 7 states that a murder committed during the commission of, or in flight from the vicinity of committing rape in the first degree elevates a homicide to murder in the first degree.
