Ma and the gang go on a crime spree across the states, receiving $300,000 in ransom for kidnapping, and additional cash from various robberies. Aware that the serial numbers on the ransom money have been recorded by federal agents, they arrange with fellow crook Pan to trade the money $100,000 in unmarked bills, but take the bills and kill him instead, They are unaware, however, that the police have found a list of the serial numbers for all Pan's bills in his coat pocket. Federal agents Scott Langham and Ross Waring are put on the case, and trace the Websters to a Southern town, where Ma is posing as a socialite. The Websters elude the police, but are forced to live meagerly while hiding out in cheap hotels. By the next Christmas, Ma returns to Centre City to visit Bert's baby boy. While she is out, her boys hold up a store, but Charlie is killed and Tom is arrested. Bert represents Tom at his extradition trial, and convinces him to plead guilty and return willingly to the city of the kidnapping. When George wants to go his own way, Ma and Eddie kill him, then hire Stitch Torey to get Tom away from the police. Their attempt fails, however, and most of Torey's gang perish. After a year, Ma and Eddie have developed a low profile while Eddie works at a cannery to support them, and Ma becomes neighborly. Unknown to Ma, Eddie arranges a hideout for some robbers he hopes to join up with and gives them a case of canned food, but the criminals' car crashes and the police get Eddie's fingerprints from the cans. On Christmas Eve, federal agents attempt to arrest Ma and Eddie, who respond with gunfire. In the hail of bullets, Eddie is killed and Ma is finally arrested.

He declines but promises to call them sometime if the need arises. They are speeding through a Connecticut village and are stopped by yokel Constable Sam Smedley. Judge Paradise, with his daughter Virginia as court clerk, fines them $5.00 each, plus $37 costs - or 30 days in jail. They, while waiting to hear from Jimmy's lawyer, are taken to the cells and are amazed to find the tumbledown jail wide open, with prisoners walking in and out. The door won't lock. The judge explains to Jimmy that Middle Village is unincorporated and broke, its sole income being traffic fines. The town's bonds, for everything from the houses to the village pump, are owned in New York. He also adds that anyone in jail in an unincorporated village is safe from the outside law - Federal,State and City. Ricky, fine paid, hustles back to New York and buys the town bonds for $40,000. Back in Middle Village, Ricky starts the ball rolling; he retains Judge Paradise, sends for Fingers, Ziggy and Crusher, and renovates the jail into a luxurious club. His lawyer then starts a stream of "customers on the lam" who pay $1000 a week for the comfort and protection of the Middle Village Jail. New fire chief Crusher, police chief Ziggy and the others board with Henrietta, a maiden lady with aspirations of becoming a gun moll. She also startles them with her collection of wanted posters, their pictures among them. Louie and Henrietta fall for each other. Virginia, in love with Ricky, tries to talk him into doing big things for the town, such as reopening its one-and-only factory. Ricky agrees when the Army offers a defense contract for shell casings. Meanwhile, Chink has gotten out of the Army and buys Louie's half interest in Middle Village. He tells the "boys" they are suckers for letting Ricky spend the jail "take" on civic improvements and he plans to wreck the factory deal.

Joe Torelli, who thinks he should be the leader of the gang, is suspicious and grows more so after the protection collection money starts to roll in, and nobody sees the money after it is turned over to Rogers, who tells them that "Baby Face" is handling the dough. Complications arise when Edward/"Baby Face" meets Virginia Clark , head of a transportation company, who has had a truck wrecked when she wouldn't pay the protection money. Edward writes her an insurance policy and promptly pays off when a second truck is wrecked. This starts a rash of business to Acme, and as fast as the gang shakes down trucking companies and wrecks their trucks, Edward pays the merchants on their policies, and this puts a serious dent into the gang's cash flow. Torelli learns that Edward is "Baby Face". So Torelli kidnaps Edward's sweetheart Virginia.

But when Powell learns that Character is about to have a baby, he returns to her. Jigger tries to make Kay the band's singer and, after this fails, runs off with her. She leaves him with nothing but a nervous breakdown. Back at the roadhouse, after his recovery, Kay shows up, has a quarrel with Davis, shoots and kills him, and plans to take back up with Jigger, who knows better but just can't help himself. While she is waiting in a car for him, along comes cripple Brad Ames, who she put in that condition, and he gets in and drives the car over a cliff, leaving no survivors in the two-passenger crash. The band is back together at the end, still using boxcars as their transportation, but happy playing the blues.

In Dec 1933, after Prohibition is repealed, Touhy decides to go "straight" because he is tired of pressure from Warren and the police. Needing money to buy a brewery, Touhy asks businessman Joseph P. Sutton to repay the $200,000 that he owes him. Although Sutton has the money, he claims that he does not, and his partner, Edward Latham, advises him to stall Touhy. Fed up with waiting, Touhy and his men kidnap Sutton and eventually collect $70,000 ransom from Latham. After Sutton is released, Warren pressures him to identify Touhy's gang as the kidnappers, and the reluctant businessman finally does so, although he does not reveal his prior connections to Touhy. While Touhy and his men are leaving the area, they are involved in a minor automobile accident that leads to their arrest. During their trial, Smoke testifies against Touhy and the others, who are found guilty and sent to serve ninety-nine-year sentences in the Stateville Peniteniary at Joliet, Illinois. Touhy is infuriated by Smoke's betrayal, and as the next eight years pass, continually tries to obtain a new trial. Smoke, who has been in hiding, is caught by some of Touhy's followers on the outside and framed for a crime he did not commit. Smoke is then sent to the penitentiary, and after being terrorized by Touhy, agrees to recant his testimony and help to free the gang. Smoke is killed by another prisoner before he can talk, however, and a desperate Touhy plans to escape from the prison. With the help of a prison guard, Touhy and his cellmate, George Carroll, escape along with Owl, Troubles, Icebox, Maxie and Rowden, another prisoner. Because the United States is now involved in the war, Touhy knows that the men will be arrested if they are caught without draft cards, and so orders Carroll and Rowden to rob unsuspecting citizens of their cards. The Federal Bureau of Investigation then takes over the case, as Touhy and his men have violated the Selective Service Act, first by not notifying the draft board of their "change of address," and then through their theft of the draft cards. Maxie's drunken carelessness causes Touhy to beat him viciously, and after Maxie and Icebox leave the gang, Icebox is arrested and informs the police of Touhy's whereabouts. Soon after, Rowden and Carroll are killed when F.B.I. agents attempt to apprehend them. Working with Warren, the F.B.I. then surrounds the apartment where Touhy, Troubles and Owl are living, and Owl convinces Touhy to surrender quietly, telling him that it is now time to pay for being on top for so long. Touhy and his men are then returned to Joliet.
