Neal was not part of the curse as he had already left the Enchanted Forest before the curse, and as such could have joined Emma and Henry. However, it is explicit that everyone from the Enchanted Forest would have to return to their original land, with Emma able to escape this fate due to being the savior.
Peter Pan removes the black cuff from his left arm and magically puts the cuff on Gold, rendering him powerless. Next Pan pushes him across the room. When Pan throws out his arm to do this, the black cuff is back on his left arm.
CORRECTION: It's not the black cuff that is shown on Peter's arm, it's the brown cuff that Peter wears on both wrists that is shown. The brown cuffs can be seen on both wrists as Peter is laying on the bed before he wakes up.
When Pan freezes everyone, you can see Regina blinking several times, Neal moving his eyes and swallowing and Belle also move her face. However, multiple times in the show and the spin-off, it is shown that victims of temporary magic paralysis can still move their eyes.
Regina says that "these past years" will be erased from Emma and Henry's memories. However, if one pays attention to the timeline, Emma arrived in Storybrooke in October 2011, and the curse was broken shortly after Kathryn disappeared in February 2012. The entirety of Season 2 and the Neverland plot are back-to-back and would have occured over months at most, meaning this episode is still set less than a year after Emma came to Storybrooke.
