This is a violation of the United States Fair Labor Standards Act that states that employers may not impose unreasonable restrictions on restroom use, making employees clock out to go to the bathroom is considered to be an unreasonable restriction, it can cause people to have accidents because sometimes they would rather try and hold it in order to not loose wages. Though the Act also states that employees cannot make excessive use of bathroom breaks either, an employer is allowed to monitor employee bathroom break time if it becomes excessive, and if the employee's bathroom breaks exceed 20 minutes per eight hour shift the employer is then allowed to dock their pay. If an employee continues to abuse bathroom breaks after having the excess time docked from their wages and after being written up it can be legal grounds for termination.
