Kathryn's deputy DA boyfriend apparently is in charge of prosecuting the bank robbers. Typically, when an employee of a district attorney's office is the victim of a crime, prosecution of that crime is handled by another county's DA office to avoid any conflict of interest issues. At the very least, prosecution would not be handled by someone with a close, personal relationship with one of the victims. Even if the relationship with Kathryn is a secret, her prosecutor boyfriend has an ethical obligation to step aside as prosecutor.
The attorney representing Malcolm Jones' bank in the wrongful-death lawsuit brought by the security guard's widow seems to chastise Malcolm for alerting her to his numerous requests for increased bank security. Her comments suggest that this information will not come out, unless Malcolm pushes the issue. In reality, internal communications about security needs likely would come out as part of the litigation discovery process. Although Malcolm was motivated by a desire to help the widow, the attorney should be grateful for his alerting her to weaknesses in the case so early on so she is not caught off guard.
