• SPOILER: While it's true that the US Constitution does forbid a person being tried for the same crime more than once, had Libby in fact murdered Nick at the end, that would have been a separate crime, for which she could have been tried and punished. Being tried for a crime does not give a person license to then go and commit that crime.
