While double jeopardy is a real legal concept (created with the dual purpose of preventing overzealous prosecutors from punishing defendants found not guilty and being part of the speedy trial process), this film stretches and breaks that concept.

If it is discovered that you didn't commit a murder you were convicted of due to the fact that the the victim is still alive, that does not give you a free pass to kill that person. You were prosecuted for a specific set of facts and circumstances (e.g., you murdered your husband on Dec 13, 2001 between 8 and 10 PM). Changing those facts and circumstances (e.g., murdering your husband on Nov 3, 2003) means that double jeopardy no longer applies.
