Supreme Court Justice Clarence Thomas has been criticized for his remarks in a case about the January 6, 2021, Capitol riot. The criticism stems from Thomas’ questioning and his wife’s alleged involvement in the conspiracy surrounding the events leading up to the riot.
In the Supreme Court hearing on a case related to the Capitol riot, Thomas raised the question of whether the federal government had previously charged individuals with obstruction of an official proceeding in the context of violent protests. This statement received backlash on social media, with some critics interpreting it as downplaying the severity of the insurrection.
Former CNN legal analyst Jeffrey Toobin criticized Thomas, saying that his wife’s alleged connection to the conspiracy influenced his handling of the case. Thomas’ wife, Virginia Thomas, had conversations with former White House Chief of Staff Mark Meadows, where she urged him to overturn the 2020 election results. Virginia raised funds...

On Wednesday, an Arizona grand jury indicted 18 of Donald Trump’s allies for trying to overturn his 2020 election loss in the state.
Boris Epshteyn, a former White House aide who has remained one of Trump’s closest advisers, former New York City Mayor Rudy Giuliani and former White House Chief of Staff Mark Meadows are three of 18 indicted allies. Their names were redacted in documents released, but court officials confirmed that they were included in the group charged.
Arizona Attorney General Kris Mayes (D) announced the indictment Wednesday night. She focused on the 11 people who acted as pro-Trump electors in Arizona.
“A state grand jury made up of everyday regular Arizonans has now handed down felony indictments for all 11 Republican electors as well as several others connected to this scheme,” Mayes stated.

In the final three days of his presidency, Donald Trump had something weighing heavily on his mind, causing him to reverse decisions rapidly as he swore angrily in the White House.
The source of the then-outgoing president’s anger had nothing to do with his failed attempts to subvert the 2020 election results, or the incoming president, Joe Biden. It was about Snoop Dogg, the man this magazine once dubbed “America’s Most Lovable Pimp.”

The Joe Biden presidential campaign is positioning the 2024 election as a referendum on democracy. But a new poll suggests that defending America’s constitutional system of checks and balances is no longer an electoral slam dunk.

When former President Donald Trump lost the 2020 election, he hired Ken Block’s data mining firm to try and find evidence to back up the wild allegations Trump and his campaign were making about voter fraud. Instead, Block found none, and now his work could be used to help prosecute Trump.

The Supreme Court announced last week that it would take up a case considering restrictions on the most widely-used method of abortion in the United States: the abortion pill. Under a worst-case scenario for American women, that case could have triggered a full reversal of the Food and Drug Administration’s approval of mifepristone, cutting off access to the medication across the country. That didn’t happen. The Supreme Court said it would only consider a more narrow set of questions about regulatory changes that have made the abortion pill more accessible in recent years.

A federal judge ruled on December 19 that Rep. Scott Perry (R-Pennsylvania) must hand over the 1,659 messages to federal investigators.
The judge found that the communication records had not been protected by the “speech and debate” clause of the U.S. Constitution.
This court order is the most recent twist in the investigation of the January 6 Capitol riots which has made its way through courts for months and implicated Perry.
His phone was seized by the FBI in late 2022 as part of the federal investigation into the efforts to interfere with the 2020 election’s certification.
This happened before Jack Smith had been appointed special counsel.
The investigators sought out a second warrant so that they could access Perry’s data. But they had to wait after Perry claimed protection under the Constitution’s “speech and debate” clause for more than 2,219 records.

Donald Trump can still be restricted in what he says witnesses as well as lawyers and court staff, and their families, in his federal election conspiracy case, an appellate court ruled on Friday.
The three-judge panel largely upheld Judge Tanya Chutkan’s gag order in the proceedings, with the exception that the restrictions do not apply to Special Counsel Jack Smith, a frequent Trump target who he has labeled “deranged.”
The judges also set parameters for the type of restrictions on Trump’s comments about attorneys and court staffers, writing that it applied in cases where his statements “are made with the intent to materially interfere with, or to cause others to materially interfere with, counsel’s or staff’s work in this criminal case, or with the knowledge that such interference is highly likely to result.”

While Pence was compelled by Special Counsel Jack Smith to testify before a grand jury in the Justice Department’s federal election interference case against Trump, the former vice president has so far skirted significant involvement in the Fulton County case.

Since the summer, Donald Trump’s legal teams have been wracked by one abiding fear: betrayal.
On one front, the former president’s inner circle has fretted about how many co-defendants in the Fulton County criminal case — or co-conspirators in the special counsel probes — might turn against him, accept a plea deal, and cooperate with the prosecutors. But lingering beneath the fear of disloyalty lies another, darker fear about whether anyone anyone still working in, or close to, Trump’s inner orbit could already secretly be working with prosecutors.

Former White House Chief of Staff Mark Meadows and five other co-defendants pleaded not guilty in the Georgia election interference case on Tuesday. The pleas came after Politico reported earlier in the day about a new trend seems to be emerging among those charged alongside Donald Trump: shift the blame onto the former president.
Thus far, 18 of the 19 defendants, including Trump, have pleaded not guilty. Hearings and court documents reviewed by Politico contain hints that some of them may be planning to point their finger at the former president in order to save themselves.

Among the 18 names listed in the 41-count indictment unsealed by a Fulton County, Georgia D.A. tonight was one not generally associated with Donald Trump and his inner circle: Trevian C. Kutti.
While not as familiar to cable news junkies as Rudy Giuliani, John Eastman or Mark Meadows, Kutti is well known in other circles as Kanye West’s onetime publicist. She is also, notably, the woman recorded on video trying to convince Ruby Freeman, a frightened Georgia election worker whom Trump had public attacked, to implicate herself in election fraud regarding the 2020 presidential election.
Counts 30 & 31 of the indictment charge Kutti, Stephen Cliffguard Lee and Harrison William Prescott Floyd with “conspiracy to commit solicitation of false statement and writings” and “influencing witnesses,” respectively.
Count 30 says the trio “unlawfully conspired to solicit, request, and importune Ruby Freeman, a Fulton County, Georgia, election worker, to engage in conduct constituting the felony...

One of the biggest pieces of evidence the Justice Department has against Donald Trump is a 2021 recording of the former president showing off an attack plan against Iran, admitting the plan is still classified because he didn’t declassify it while he was in office. CNN released audio of the recording Monday night. It’s every bit as damning as the indictment indicated.
Trump doesn’t think so, of course. In fact, he thinks the smoking-gun audio clears him of any wrongdoing. “The Deranged Special Prosecutor, Jack Smith, working in conjunction with the DOJ & FBI,...

Update: Donald Trump told Semafor and ABC News that in an audio recording of a 2021 meeting, he was not showing secret documents, but that it was “bravado.”
“I was talking and just holding up papers and talking about them, but I had no documents. I didn’t have any documents.” He said that what he had were newspaper articles and printouts of various speeches.
Trump referred to the material as “highly confidential,” while he told the participants in the 2021 conversation that it was “off the record.” The indictment claims that Trump “showed and described a ‘plan of attack'” to a writer, publisher and two members of his staff, none of whom had security clearances.
Previously, June 26: CNN obtained the audio recording of a 2021 meeting in which former President Donald Trump discussed having secret documents he did not declassify.

Earlier this year, Donald Trump sent some of his lawyers and political advisers on a “small fact-finding mission,” as a person with knowledge of the matter describes it to Rolling Stone. The former president wanted to know, according to that source and another person close to Trump: “What is Mark doing?”
Trump was referring to his former White House chief of staff, Mark Meadows. Justice Department investigators and Special Counsel Jack Smith’s office had been keen on questioning Meadows under oath about Trump’s efforts to subvert the 2020 election and to hoard government documents.

Update, 5:38 a.m. Pt, Friday: Donald Trump’s federal indictment has not yet been unsealed, but some details are emerging of what evidence the Justice Department’s special counsel Jack Smith has gathered.
CNN reported on Friday that it obtained the transcript of an audio recording in which Trump, at a meeting in 2021 when he was out of office, admitted that he retained military information that he had not declassified.

The audio recording was obtained by prosecutors, but it is unclear if it is a factor in the indictment.
